of the Sentence in the above Case

COURT: Stand up. There is only one sentence which by law I am able to pass, you having been found guilty of murder. That is one of life imprisonment, and that is the sentence I impose on you.
In respect of the 2nd count, that of preventing a lawful burial of a body, that is an offence where the maximum sentence prescribed by law is one of 7 years’ imprisonment.
These offences are of the category for which there is obviously no tariff. The courts have said repeatedly that they are to be sentenced on their own facts. The facts which we have all had to sit through and listen to are almost the worst that’s possibly imaginable. It would be no exaggeration to describe your conduct as barbarous.
You killed a 16-year-old girl and then you disposed of her body in the most revolting manner. I regard the appropriate starting point after trial as being one of 6 years’ imprisonment. You are entitled to a one-third discount for your plea of guilty. That makes a sentence of 4 years. That obviously has to be served concurrently with the sentence of life imprisonment on the 1st charge.
There is just one more thing I want to add, and that is that by their verdict the jury plainly rejected the lies you came along and told about the conduct you attributed towards the police.
Please refer to CACC251/2009 for the relevant appeal(s) to the Court of Appeal. |
