CRIMINAL CASE NO. 468 OF 2009

----------------------

  HKSAR
  v.
  Tai Cheuk-kin

----------------------

Before:

Deputy District Judge J. Lam

Date:

25 September 2009 at 2.37 pm

Present:

Mr A A Hoosen, Counsel on Fiat, for HKSAR
Mr Wong Wing-chi, Stephen, instructed by Messrs Leung & Lien, assigned by the Director of Legal Aid, for the Defendant

Offence:

Possession of a dangerous drug (管有危險藥物)

---------------------------

Reasons for Sentence

---------------------------

1.Defendant is convicted by this court of possession of a dangerous drug, namely 12.3 grammes of ketamine pure. He pleads guilty to this charge and this court has obtained various reports for him.

2.The recommendation of the intake officer is that defendant is suitable for admission to DATC. Certainly he has had an addiction for quite some time, and due to his weak willpower he has not given up despite being given chances on more than one occasion by previous courts.

3.Defendant is now 20, not yet 21 but he has already got, including this present case, five convictions. Two of them are related to drugs, including this one. Of course, he has one robbery convictions and two other theft convictions. He had been put on probation orders for more than once but apparently probation did not work out for him.

4.The facts relating to this case and relating to defendant show that defendant’s root of problem is addiction. As he is suitable for admission to DATC I will make that order for his plea in this case.

5.I order defendant to be sent to DATC, conviction recorded and in the circumstances the PO order imposed upon him by Fanling Court in case FL1229/2009 will be discharged and substituted with another DATC order, also conviction recorded.
