CACC000744/1972 IN THE SUPREME COURT OF HONG KONG APPELLATE JURISDICTION CRIMINAL APPEAL NO. 744 OF 1972 -----------------
----------------- Coram: Huggins, J. Date of Judgment: 30th November, 1972. ----------------- JUDGMENT ----------------- 1. The Appellant appeals against a conviction for unlawful possession of dangerous drugs. He was arrested in the street after he had been searched and a packet of dangerous drugs found in his trousers pocket. The packet was found to contain dangerous drugs. 2. The plea, when the Appellant was originally arraigned, and his unsworn statement at the trial were that nothing was found on him when he was searched but that the police planted the drugs on him. This was a case where it was one man's word against another, the Appellant's evidence being unsworn. The learned magistrate decided that the police officer was telling the truth and I have no reason to believe that he came to a wrong conclusion. 3. The appeal is dismissed. 30th November, 1972.
