1. What I shall do then is, as far as sentencing the 1st defendant on the 2nd charge, I shall impose a financial penalty although, as I say, a serious view can be taken on this offence. However serious a view I take, the defendant has still been in custody for a period of up to four weeks in respect of these matters, and I must bear that in mind when considering the appropriate level of penalty.
