CRIMINAL CASE NO. 768 OF 2009

--------------------

  HKSAR
  v.
  Lam Yuk-yin, Carman (D1)

--------------------

Before: Deputy District Judge Casewell

Date:   19 November 2009 at 3.07 pm

Present: Mr Robert Andrews, Counsel on fiat, for HKSAR
Mr Oliver Davies, instructed by Wong & Co., for the 1st Defendant
Offence: (1) Trafficking in a dangerous drug(販運危險藥物)
  (2)  Obstructing a police officer in the due execution of his duty
(阻撓在正當執行職務的警務人員)

---------------------

Reasons for Sentence

---------------------

1.What I shall do then is, as far as sentencing the 1st defendant on the 2nd charge, I shall impose a financial penalty although, as I say, a serious view can be taken on this offence. However serious a view I take, the defendant has still been in custody for a period of up to four weeks in respect of these matters, and I must bear that in mind when considering the appropriate level of penalty. Clearly, no further sentence of imprisonment would be appropriate. So, I will simply impose a financial penalty. There will be a fine of $5,000.
