Paragraph 22 at page 10 of the Judgment is amended as follows: -
“22. The Plaintiff took out a summons dated 15.10.2009 for an order that judgment on liability be entered for the Plaintiff against the 1st Defendant, leaving the quantum of damages to be assessed. This is an inappropriate application, as the trial would commence on 16.10.2009. The liability of the 1st Defendant should be considered in light of all the evidence. The application taken out by the Plaintiff is simply redundant. I dismiss this summons. The costs of this application are to be borne by the Plaintiff.”
