HCCC419/2009 IN THE HIGH COURT OF THE HONG KONG SPECIAL ADMINISTRATIVE REGION COURT OF FIRST INSTANCE CRIMINAL CASE NO. 419 OF 2009 ----------------------
----------------------
--------------------------------- Transcript of the Audio Recording --------------------------------- COURT: The 21 year old defendant was committed to this court from Eastern Magistracy for sentence in respect of an offence of trafficking in 419.9 grammes of ketamine. The facts of the offence are straightforward. On 7 July 2009, a police team on an anti-narcotic operation gained access to the defendant's premises and found the drugs in his bedroom together with some packaging equipment. The drugs themselves were contained in 210 plastic packets. The applicable guidelines of sentence are those contained in Hii's case. I take a starting point of sentence of 10 years' imprisonment. Mr Tse, for the defendant, has brought to my attention the background of the defendant and his family circumstances but the only material mitigation available to the defendant is his plea of guilty. On that basis the starting point of sentence is discounted to a final sentence of 6 years 8 months' imprisonment. |
