CACC000078/2002 CACC 78/2002 IN THE HIGH COURT OF THE HONG KONG SPECIAL ADMINISTRATIVE REGION COURT OF APPEAL CRIMINAL APPEAL NO. 78 OF 2002 (ON APPEAL FROM DCCC 923 OF 2001) ______________
______________ Coram: Hon Mayo VP in Court Date of Hearing: 5 June 2002 Date of Judgment: 5 June 2002 _______________ J U D G M E N T _______________ 1.There was a full trial of this matter when the Judge had all of the evidence before him and nothing which was said this morning persuades me that the trial was in any way unsatisfactory. The applicant had a fair trial and that there was an abundance of evidence in support of his conviction. His application for leave to appeal against conviction is dismissed. 2.So far as sentence is concerned, this was a very serious and vicious attack with a knife and the 4-year sentence which was imposed upon him can only be described as a merciful sentence. It could have been a lot longer. That application is also dismissed.
