1. The Defendant having failed to appear, judgment on liability was entered against it with damages to be assessed pursuant to the order of Stone J on 6 August 2009. The Registrar subsequently issued directions for the filing and serving of affidavits for the purpose of the assessment, ordering that they do stand as evidence in chief and may be read at the assessment hearing.
