On 23 July 2004, the plaintiff Mr. Chan (“Chan”) was engaging in the work of removing garbage and debris in a construction site situated at Lot Nos.1008, 1009 R.P. in DD244, Nam Pin Wai, Sai Kung (“the 1 st construction site”).
