CRIMINAL CASE NO. 1378 OF 2009

-----------------------------

HKSAR
v.
Wu Weixiong (D1)

-----------------------------

Before: H HJudge Tallentire
Date: 26 May 2010 at 11.13 am
Present: Mr Liu Kit-ling, Counsel on fiat, for HKSAR
Mr Arthur Lam Hei-wei, instructed by Raymond C P Lo & Co., assigned by the Director of Legal Aid, for the 1st Defendant
Mr Peter Lam King-pok, of Messrs Chan & Tsu, assigned by the Director of Legal Aid, for the 2nd Defendant
Offence: (1) Doing an act preparatory to manufacturing a dangerous drug (作出準備製造危險藥物的作為)
  (2) to (3) Resisting a police officer in the due execution of his duty (抗拒在正當執行職務的警務人員)

------------------------------

Reasons for Sentence

------------------------------

1.D1, you have been convicted after trial of Charge 2.  That is an offence of resisting a police officer in the due execution of his duty, contrary to section 36(b) of the Offences against the Person Ordinance, Cap. 212.

2.The facts are well known to the court. The facts have been referred to at length within my verdict.  The simple fact is that fortunately the officer was not severely injured.  The injuries were very light indeed.  Having said that, the courts will not tolerate anyone preventing police officers going about their lawful duty, especially resulting in acts of violence.

3.You are a man of clear record.  You will be sentenced in all the circumstances, and I note the limited mitigation.  With my invitation, no criticism of Mr Lam, there is no point in putting a lot before me.  As given, therefore, you will go to prison for a period of 42 days.  I thereby order your immediate release and presumably you will be repatriated to the mainland.
