CACC000854/1973 IN THE SUPREME COURT OF HONG KONG (APPELLATE JURISDICTION) CRIMINAL APPEAL NO. 854 OF 1973 -----------------
----------------- Coram: Huggins, J. Date of Judgment: 3rd December 1973. ----------------- JUDGMENT ----------------- 1. These Appellants were each sentenced to 15 months' imprisonment upon their pleas of Guilty to a charge of robbery. They appeal against sentence and the only thing either of them has emphasised is that he was a first offender. 2. The case was one of a type which is all too frequent at the present time. About 1 o'clock in the morning these two men entered a lift with a Chinese woman: one of them grabbed her round the neck and twisted her arm behind her: they demanded money and the second Appellant snatched her handbag and took $90 from it: they then ran out of the lift and were fortunately seen by a police patrol as they left the building. After a considerable chase they were arrested in a public light bus. 3. This was a violent crime committed on a woman who was going about her lawful occasions and persons such as she must be protected. In my view sentences of 15 months adequately took due account of the fact that these were first offenders and the appeals are both dismissed. Representation: 3rd December 1973. |
