JUDGMENT

1. The appellant pleaded guilty to one charge of conspiracy and was sentenced to three years' imprisonment. He appeals against that sentence. At the time of the offence, he was a sergeant in the Royal Hong Kong Police Force. He was charged with other members of the Police Force with one count of conspiracy to accept periodic sums of money from persons who were operating as illegal bookmakers. The appellant not only pleaded guilty, he co-operated with the authorities in every way.

2. Mr. Macdougall, who appeared on behalf of the Crown, kindly produced for the Court a list of cases of a similar nature showing the sentences imposed in each case. The cases are all cases of conspiracy and the defendant in each case was a member of the Royal Hong Kong Police Force. They cover the years 1974 to 1976. This list shows that the sentence imposed upon the appellant in this case is too heavy.

3. For these reasons, we think it proper to reduce the sentence of three years to one of eighteen months' imprisonment.
