D E C I S I O N

1.This is the Applicant’s application for periodical payments under section 10(1), (4) and (5) of the Employees’ Compensation Ordinance, Cap.282.

2.The Respondent is absent in court; so the Applicant’s evidence as embodied in his affirmation in support of this application remains unchallenged.  I accept such evidence. 

3.I therefore make the following orders:

1. The Respondent do continue to make periodical payments to the Applicant during the sick leave period pursuant to section 10(1), (4) and (5) of the Employees' Compensation Ordinance, Cap.282, but in any event, such periodical payments shall not be payable for any period commencing from 8 September 2011.

2. The costs of this application be to the Applicant.

3. The Applicant’s own costs to be taxed in accordance with Legal Aid Regulations.
