CRIMINAL CASE NO. 1256 OF 2010

----------------------

  HKSAR
  v.
  Law Siu-lung
----------------------
Before: Deputy District Judge A. Yuen
Date: 17 December 2010 at 2.45 pm
Present: Miss Chan Siu-tak, Monica, PP of the Department of Justice, for HKSAR
Mr Ng Ping-lin, Raymond, of Messrs Thomas Li & Yu, for the Defendant
Offence:  Trafficking in a dangerous drug (販運危險藥物)

---------------------

Reasons for Sentence

---------------------

1.You pleaded guilty to one count of trafficking in dangerous drugs. Facts revealed that on 8 September this year, at around 6.15 pm, you were intercepted by police while walking along Sau Mau Ping Road. Later, you were taken to United Christian Hospital for a body cavity search. It was found in your possession one condom containing 41.26 grammes of a mixture containing 33.82 grammes of heroin hydrochloride. You admitted that you helped a person called Ah Ming to bring these drugs from Shenzhen to Hong Kong with a reward of HK$500.

2.There is a clear sentencing guideline for this kind of offence.  For a quantity of heroin between 10 and 50 grammes, the sentencing guideline is 5 to 8 years’ imprisonment as starting point.

3.In this case, the only mitigating factor is your plea of guilty.  This court will take 6 and a half years as the starting point.  Because of your plea, I reduce it to 4 years and 4 months.
