CRIMINAL CASE NO. 1268 OF 2010

----------------------

  HKSAR
  v.
  Yeung Shek-kin

----------------------

Before:

Deputy District Judge A Yuen

Date:

23 December 2010 at 11.39 am

Present:

Mr Kwok Wing-lung, SPP of the Department of Justice, for HKSAR
Ms Chong Chew-then, of Messrs Chong & Yen, for the Defendant

Offence:

Trafficking in a dangerous drug (販運危險藥物)

--------------------------

Reasons for Sentence

--------------------------

1.You have pleaded guilty to one count of trafficking in dangerous drugs.

2.Facts revealed that, on 23 September this year, at around 10.53 pm, you were stopped and searched by police at the junction of Bute Street and Portland Street, and it was found, in your possession, a plastic bag containing 13.95 grammes of a mixture containing 11.65 grammes of heroin.

3.You admitted that you were delivering the drugs for someone else for a reward of HK$200 to HK$300.

4.The sentencing guideline for this kind of offence is clear.  For a quantity of heroin from 10 to 50 grammes, the starting point should be from 5 to 8 years' imprisonment.

5.In this case the only mitigating factor is your plea of guilty.

6.I will take 5 years as the starting point. Because of your plea I will reduce it to 3 years and 4 months.
