CACC000935/1975 IN THE SUPREME COURT OF HONG KONG (APPELLATE JURISDICTION) CRIMINAL APPEAL NO. 935 OF 1975 -----------------
----------------- Coram: Cons J. Date of Judgment: 7th November, 1975. ----------------- JUDGMENT ----------------- 1. These three appellants pleaded guilty to membership of a triad society. They are all mature men and with experience of the criminal world well before they joined such a society. In those circumstances there may be some who would think that the sentences of six months imposed by the learned magistrate were justified. But such a sentence is not usual unless there is some evidence to satisfy the Court that there is some form of what might be termed active membership. There is a suspicion in this case but I do not think it goes further. The sentences are therefore reduced to two months' imprisonment, but in all the circumstances I think the orders for police supervision are appropriate and will stand.
