It should be ‘had’, so that it should read, ‘Also, at around the time he had noticed that his brother had written on drawings made in a notebook by the deceased. The Word ‘the direction’ were omitted in the first line of paragraph 31, so that is should read, ‘Although the judge went on to direct the jury that the direction was of ….’ Dated 10 March 2011.
