Reason for sentence

1. The Defendant pleaded guilty to a charge of burglary.

2. PW1 patrolled around the building, he heard noises and saw movement of the electric wires on the staircase.

3. Police was called. Defendant was found at the rear of the building.

4. He was arrested. The Defendant admitted under caution that he knew it was a vacant domestic building. He entered the building via the rear lane and stole 4 bundles of electric wires.

Criminal record:-

5. The Defendant has 3 previous convictions, all unrelated. Two were Possession of Dangerous Drugs.

Mitigation :-

6. The Defendant is 31 years old. Single. Lived with his mother and sister before the arrest. Father passed away in 1997. The Defendant was a casual worker in a construction site and earned about $8000 to $9000 per month. However, he spent more than he could earn because he is a drug addict. He intended to sell the electric wires to earn more money. He has now turned into a Christian in Lai Chi Kok and he wished to turn over a new leaf.

Sentence :-

7. This is a domestic building burglary, the usual starting point is 3 years, the only mitigating factor is the Defendant’s guilty plea, I therefore, reduce his sentence to 2 years.

8. He is sentenced to 2 years.
