1. On 30 November 2007 the Plaintiff’s vessel “Pontodamon” and the Defendants’ vessel “He Da” collided at around 2125 hours in the port area of Shanghai (more precisely, about 31 degrees 04.5 N, 122 degrees 37.5 E). At the time the sky was overcast, but visibility was good for some 12 nautical miles. The sea was slight to moderate and there was a force 3 or 4 wind blowing in a north-easterly direction.
