CRIMINAL CASE NO. 607 OF 2011

----------------------

  HKSAR
  v.
  Feng BO

----------------------

Before: Deputy District Judge A. Yuen
Date: 19 July 2011 at 10.32 am
Present: Mr Kwok Wing-lung, SPP of the Department of Justice, for HKSAR
Mr William Leung, of William K W Leung & Co., for the Defendant
Offence: Possessing false instruments (管有虛假文書的罪行)

---------------------

Reasons for Sentence

---------------------

1.You pleaded guilty to one count of possessing of false instruments, namely five forged credit cards.

2.Facts revealed that on the 13 April this year, you were stopped and searched by police in Mongkok, and it was found in your possession six credit cards, five of which were confirmed to be forged.

3.Furthermore, you was found one of which had been used in the transaction involving a sum of HK$351, that transaction took place approximately 1½hours before you were intercepted.

4.In sentencing you, I will take into account your plea of guilty, the mitigation put forward by your counsel, the number of forged credit cards involved and also the value of the property involved.  As rightly pointed out by your counsel, possession of forged credit card is a serious offence and an immediate custodial sentence is the norm.  I take 3 years as a staring point because of your plead I reduce it to 2 years.
