COURT: The defendant pleads guilty to one count of trafficking in a dangerous drug involving 62.2 grammes of “Ice”.
At about 2.40 am on 7 December 2010 a team of police officers were carrying out an operation in the vicinity of Baker Street and Ming On Street. They saw the defendant standing there with a female.
This aroused their suspicion. The officers subsequently searched the defendant outside No. 24 Whampoa Street. They found three packets of “Ice” from the right rear pocket of his trousers. The retail price of the drug was about $43,000.
The defendant admitted today that he trafficked the drug for a reward of $3,000. The defendant is 39, single. He received education up to Primary 6. He has six previous convictions. He was last sentenced to 6 years’ imprisonment in the year 2005 for trafficking in a dangerous drug. He was an addict at the time of the offence.
He informs this court that he committed the offence because of financial problems as he was unemployed.
According to the sentencing tariff, AG v Ching Kwok Hung the starting point for the amount of “Ice” in this case should be 9 years and 7 months’ imprisonment.
I deduct 3 years and 3 months for his plea. There being no other reasons for further reduction I sentence the defendant to 6 years and 4 months’ imprisonment.
