CRIMINAL CASE NO. 467 OF 2011

----------------------

  HKSAR
  v.
  Lam Kai-wing
----------------------
Before: Deputy District Judge Woodcock
Date: 24 August 2011 at 10.27 am
Present: Ms Cindy Lee, Counsel on fiat, for HKSAR
Mr Cheung Kin-bor, Michael, instructed by Francis Kong & Co., for the Defendant
Offence:  Trafficking in dangerous drugs (販運危險藥物)

---------------------

Reasons for Sentence

---------------------

1.Defendant, you were originally charged with trafficking in dangerous drugs. After a hearing I accepted your plea and convicted you of simple possession of the same drugs.

2.I called for a drug addiction treatment centre report. I will not repeat the contents of the report.  But rather odd that you have not come into contact -- according to the report and the fact that you have no previous drug record, it is rather odd that you have started to dabble with drugs in your 50s.  Usually, it is those that are very immature and young who start to dabble with drugs.

3.Clearly, you have been a responsible father and a responsible husband, and your daughters have written a letter explaining their upbringing and how hard you worked to bring them up.

4.After seeing this report and noting that the medical officer is of the view that you are a drug dependant, I will consider a drug addiction treatment centre order.  But you must understand if you commit further drug offences in the future, then you will probably be serving terms of imprisonment as opposed to treatment centre.

5.Don’t forget this was not an unfortunate stop-and-search; the police had information on you.  So for this offence, I will sentence you to a drug addiction treatment centre order and the conviction will be recorded.
