So Chun-man v. The Queen
|
CACC001218/1976
Coram: Briggs, C.J. Date of Judgment: 4th December, 1976. ----------------- JUDGMENT ----------------- 1. This is an appeal against a sentence of two years' imprisonment passed on the appellant for the offence of perjury. The appellant pleaded guilty. 2. He gave false evidence to assist a cousin in a civil case. That case, however, was dismissed and the appellant's evidence was not believed. 3. The appellant has a history of psychiatric trouble and has tried to commit suicide at least on two occasions. He has a clear record. 4. Taking all the circumstances into consideration I think the period of two years' imprisonment is excessive and so the appeal of the appellant is allowed to the extent that a sentence of one year's imprisonment is substituted for the sentence of two years.
Representation: P. Woo (Kwong, Lam & Chan) for Appellant. Lucas for the Crown/Respondent. |
