COURT: The Accused, you have pleaded guilty in the Magistrates’ Court to one charge of trafficking in a dangerous drug and you have been committed to this court for sentence today.
The drugs involved are 49.02 grammes of a crystalline solid containing 47.86 grammes of methamphetamine hydrochloride.
These drugs were brought into Hong Kong from across the border and therefore call for enhancement.
In all the circumstances, I adopt a starting point of 8½ years’ imprisonment, enhance it by 1 year, making a total starting point of 9½ years’ imprisonment.
I have taken into account everything urged on your behalf including the fact that some of the drugs could be used by you for your own consumption and the fact that you have pleaded guilty.
Taking all of that into account and all the other mitigating factors into account, I am prepared to give you a discount of slightly more than one-third and I sentence you to 6 years’ imprisonment.
You are therefore sentenced to 6 years’ imprisonment.
