COURT: The defendant pleaded guilty in the Magistrates Court to one count of trafficking in a dangerous drug. He was committed to this court for sentence.

On the material day in question the defendant was intercepted by police officers. Inside his car police found 12.56 grammes of “Ice”. The defendant admitted under caution that he was asked by one Ah Sing to deliver the drug for HK$600.

The defendant is 27, a driver, making approximately $14,000 a month. He committed the present offence because of financial pressure.

Guidelines on sentencing are clear. The starting point for trafficking in 12 grammes is one of 7 years’ imprisonment. Apart from the defendant’s plea I do not see any other mitigating factors which might justify further reduction. The defendant of course is entitled to his usual one-third discount.

As such he is sentenced to 4 years and 8 months’ imprisonment.
