COURT: Defendant, you have been convicted after trial of trafficking in 67.1 grammes of a crystalline solid containing 64.89 grammes of methamphetamine hydrochloride.

You were effectively caught red-handed by police who were on anti-dangerous drugs patrol in the vicinity of Kai Ming Street, Hung Hom, when from the outside compartment of the LV bag that you had slung across your shoulder, the drugs being the subject matter of the charge were found in five separate resealable plastic bags.

After your arrest, under caution, you immediately told the police that you were bringing the stuff for someone but you had not been paid yet.

There are no mitigating features here, as you have been convicted by the jury after trial, but I accept from your counsel that there are no aggravating features.

The relevant sentencing guidelines can be found in Attorney‑General v Cheng Kwok Heung [1991] 2 HKLR 125, and for trafficking in 10 to 70 grammes of “Ice”, the level of sentence ranges between 7 to 10 years.

The amount that you carried that morning falls just below the 70 gramme mark, and accordingly I sentence you to 9½ years’ imprisonment.
