1. The plaintiff in this action applied for summary judgment against the 1 st and 3 rd defendants on the basis of a loan agreement and a guarantee both dated 4 January 2010. The writ was issued on 12 April 2013. The statement of claim was served on 8 May. The Order 14 summons was issued on 21 June. At the end of the hearing of the application on 26 September I granted unconditional leave to defend. These are my reasons for doing so.
