1. This is an appeal against the decision of Yuen JA refusing leave to the Plaintiff to adduce fresh evidence on appeal. In the judgment of 30 May 2013, Her Ladyship refused the application of the Plaintiff on the ground that the Plaintiff did not satisfy the first limb of the test in Ladd v Marshall [1954] 1 WLR 1489.
