Hon Cheung JA (giving decision of the court) :

1.This is the applicant’s application against our decision of 3 May 2013.  We refused to extend time for the applicant to appeal against the decision of Poon J who refused to grant leave to the applicant to commence judicial review.

2.The application is not based on the ‘as of right’ limb of section 22(1) of the Hong Kong Court of Final Appeal Ordinance (Cap. 484).  Our decision is fact specific.  We are not satisfied that any issue of great general or public importance is involved.  Nor do we see any issue arising from the ‘or otherwise’ ground.

3.Accordingly the application is refused.
