COURT: On 13 June 2012, police acting on information intercepted the defendant in Mongkok. He was searched and was found in possession, inter alia, of a set of house keys. He was taken to the premises and access was gained using those keys. The premises were then searched and under the television set in the living room was found a box containing 330 grammes of cocaine, the subject of the charge remaining on the indictment.

The defendant co‑operated with the police and at an early stage admitted the drugs were his. Subsequently, when interviewed under caution, he admitted he possessed them for the purposes of trafficking.

Given the quantity of cocaine involved, I take a starting point of sentence of 13 years’ imprisonment. Given the defendant’s early admissions and his plea of guilty before me, I reduce that starting point to a sentence of 7 years 9 months’ imprisonment.

Please refer to CACC398/2013 for the relevant appeal(s) to the Court of Appeal.
