Please note the following paragraphs were inadvertently omitted from the Judgment handed down on 25 November 2013:
(1) On page 13, paragraph 42, should be added “These costs are to be borne by the defendant personally. So that there shall be no misunderstanding they are under no circumstances to be paid out of the estate nor out of the assets in the joint accounts before distribution to the plaintiff.
For the avoidance of any remaining doubt and to pre-empt any possible satellite litigation, they can only come out of the defendant’s share of the estate or out of his share of the joint accounts assets, or other funds personal to him”.
