COURT: I have to sentence you for rape, the jury having found you guilty.
It is worthy of remark that your victim was only 17 years old and it was quite clear that she was vulnerable. She had no money, she was not going home, she had lost contact with her boyfriend and you exploited that situation. You used violence, though I appreciate no more violence than was necessary to obtain what you wanted, and you used the telephone cord to tie her up.
Sentences for rape begin at about 6 years in this jurisdiction. In my judgment, your case is slightly worse than would be merited by such a starting point, though I’m not quite sure it merits a sentence of 7 years.
In the circumstances, I shall pass a sentence upon you of 6 and a half years’ imprisonment.
The only thing I should add is that I have not sought any sort of report upon you. Other than the claim to something psychiatric that happened as long ago as 1999, there is no indication that would make me take that course. I note that you have been before the courts consistently over that time without any psychiatric intervention. That is why I have sentenced you today.
