In the course of dealing with the respondent’s application for leave to appeal against a costs order made on 11 November 2013 (“the Costs Order”), Mr. Mok for the applicants raised the issue that the application is out of time. On 29 January 2014, after hearing submissions, we ruled against Mr. Mok and found that the application for leave to appeal by the respondent is not out of time. These are the reasons for our decision.
