The Applicant Ng Shing Chun appeared before the High Court on an indictment containing four counts: Kidnapping, contrary to common law (Count 1), Rape (Count 2), Rape (Count 3) and Buggery (Count 4). The victim in each case was the same woman and all the offences were averred to have been committed on the same day, 28 June 1986.
