1. The applications before me concern the plaintiff (“ Great Harvest ”) and the 1 st defendant (“ Ho ”). The former applies for summary judgment; and the latter applies for striking out of the claim. The circumstances in which these applications came about are somewhat peculiar; and both parties were the authors of them.
