ASSESSMENT OF COSTS

Hon Lam VP (giving the Assessment of Costs of the Court):

1.In our judgment of 16 October 2014, we ordered costs against the Defendant on indemnity basis.

2.We have read the costs statement of the Plaintiff of 23 October 2014.  We have also read the Defendant’s List of Objection of 4 November 2014, which, despite our order for costs on indemnity basis, was prepared on party-to-party basis.

3.Having considered these documents, we would reduce the photocopying charges of the Plaintiff to $720.  And we do not understand why there should be charges for preparation for hearing as the matter was disposed of on paper.  Thus, we would disallow item D3.  Apart from that, we would not make any further reduction bearing in mind the award is on indemnity basis.

4.The costs of the Plaintiff are therefore fixed at $132,250, payable by the Defendant to the Plaintiff forthwith.
