This is a striking out application taken out by the plaintiff for an order that paragraphs 10(a) to (n) and 11(a) of the defendant’s Amended Defence and Counterclaim be struck out and further that the whole of the Amended Counterclaim be struck out and the counterclaim be dismissed pursuant to RDC Order 18 rule 19(1)(a), (b), (c) and/or (d) and/or the inherent jurisdiction of the court.
