1. On 19 May 2003, Master Lung gave summary judgment to the Plaintiff on its claim in this action for over US$8 million together with interest and costs. The application for summary judgment was not opposed by the Defendant. However, the Defendant applied by summons for an order that there be a stay of execution on the judgment on the basis of ongoing discussions aimed at the restructuring of the corporate group of which the Defendant was a part.
