|
CACC001336/1976
Coram: Briggs, C.J., Huggins & Pickering, JJ.A. Date of Judgment: 1 March, 1977. ----------------- JUDGMENT ----------------- 1. The appellant pleaded guilty to being in possession of dangerous drugs for the purpose of trafficking and was sentenced to five years' imprisonment. He appeals against that sentence. 2. Acting upon information, the police searched his room and discovered forty-nine grammes of morphine in a bedroom cupboard. 3. The appellant has three previous convictions of simple possession of dangerous drugs. He has been drug addicted since 1973 and unemployed since 1976. He is 31 years old. 4. We think that the sentence of five years is unduly heavy in the circumstances of this case so the appeal will be allowed to the extent of reducing the sentence from five years to three and a half years' imprisonment.
Representation: Goodbody (Haldane & Co.) for appellant. Kitson for crown. |
