JUDGMENT

-----------------------------

1.By this action, the plaintiff claimed against the defendant for the sum of HK$343,460 being outstanding advertising fees from 19 April to 30 November 2012 owed by the defendant to the plaintiff.

2.Since the defendant and his witness did not turn up at trial, it was not necessary to consider the defence case.  Nonetheless, the plaintiff has called its witnesses to prove its case.  There was nothing to dispute the plaintiff’s allegations and I accepted in totality what was said by the plaintiff’s witnesses in their respective witness statements.

3.Accordingly, I found judgment for the plaintiff which has proved its case to the requisite standard and made the following orders against the defendant in favour of the plaintiff:-

(a)   payment of the said sum of HK$343,460;

(b)   interest on the said sum of HK$343,460 at 1% above the best lending rate of HSBC from the date of writ until judgment and thereafter at judgment rate until payment.

4.Finally, I made an order nisi of costs that costs of this action be paid by the defendant to the plaintiff, with certificate for counsel, such costs to be taxed if not agreed.  This order nisi shall become absolute unless any party applies to vary the same within 14 days.
