HCCC 113/2015 IN THE HIGH COURT OF THE HONG KONG SPECIAL ADMINISTRATIVE REGION COURT OF FIRST INSTANCE CRIMINAL CASE NO 113 OF 2015 -----------------
------------------
--------------------------------- Transcript of the Audio Recording --------------------------------- COURT: I will deal straightaway with sentence. The defendant will be well aware of the consequences of a conviction for trafficking in “Ice”. It certainly gives me no pleasure having to sentence a person of your age for this sort of offence. The dangers of methamphetamine hydrochloride are widely known, and I certainly don’t need to repeat them here. I suppose it’s every parent’s nightmare that their children may become entangled with drugs, let alone one that is as addictive as this one is. The law makes no distinction between those who sell drugs on account of their age, unless they are extremely young, which you were not. No parent will care whether it was an old person, a middle-aged person or a young person who supplied their children with this sort of drug, because the evil is just the same. So it is that there is a very real need to deter traffickers of all ages. There is no alternative to a prison sentence for an offence as serious as this one. You were dealing in a half-ounce quantity of “Ice”, which is a well-known quantity for those who deal in “Ice”. The guidelines in Tam Yi Chun provide the suggested tariffs for this drug based upon weight, and the least sentence - as I have indicated to your counsel - that I can impose is one of seven years’ imprisonment. Accordingly your sentence is 7 years’ of imprisonment. It would have been slightly more, but for what you told me about your intention to use some of the drugs for yourself. That’s all. |
