1. At the beginning of this hearing, pursuant to the joint application by plaintiff and the 1 st defendant, I granted leave for the plaintiff to withdraw his entire claim against the 1 st defendant, thus leaving only the 2 nd defendant’s summons that needed to be dealt with at the present hearing.
