1. This appeal is concerned with certain alterations made to House 43 ("the House") First Street, Section G of Fairview Park. Fairview Park is a very large development in Yuen Long, consisting of some 5,000 houses built in the mid-1970s. A Deed of Mutual Covenant ("the DMC") was entered into between the development company, the management company ("the plaintiff") and the first owner and subscribed to by the other owners. The defendant is the present owner of the House. It was first sold in 1976
