Matrimonial proceedings – Ancillary relief – Leave to appeal – Out of time – Reasonable prospect of success – Costs – The Respondent applied for leave to appeal against an ancillary relief order made on 13/3/2020, more than one year after the order. The application was out of time and no extension of time was sought. The Court held that the application had no reasonable prospect of success as the grounds filed merely recited past life events rather than challenging the judgment. The Court refused leave to appeal and ordered the Respondent to pay the Petitioner's costs.
