Divorce – Ancillary Relief – Maintenance – Leave to Appeal – District Court Ordinance s.63A(2) – Fresh Evidence – Ladd v Marshall – The Respondent applied for leave to appeal against a maintenance order which was phased out due to the Husband's health and income reduction. The court considered whether the Respondent had a reasonable chance of success or other reason in the interests of justice. The court found the Respondent's evidence regarding hidden assets did not meet the Ladd v Marshall test for fresh evidence as it lacked affidavit support. The court held the original maintenance order was reasonable given the Husband's health issues and the Wife's employment. Leave to appeal refused. No order as to costs.
