1. These two actions concern a family trust known as the “CW Family Trust” (“the Trust”). It was created pursuant to a settlement deed dated 11 June 2009 (“the Settlement Deed”). Clause 17, as stated in its heading, makes provisions for “[p]roper law, forum and place of administration”. It is this clause which has given rise to the applications presently before the court.
