At the core of the Applicants’ case is an allegation of bad faith, that the Respondent Director of Lands (“Director”) acted with an ulterior motive in his dealings with them and in the decision he made. The central question is whether the allegation of bad faith is enough to make the impugned decision amenable to this Court’s supervisory jurisdiction, when in ordinary circumstances it likely would not be.
