1. 申請人的申請是要求土地審裁處頒令答辯人向他作出款額為$623,871.60 的“特惠津貼”的補償。

2. 申請人自1983年起，便在元朗洪水橋田廈路124約1175地段經營 “金華園養豬場”。1999年5月26日，香港特區政府因興建西北鐵路，遂把“金華園養豬場”清拆。1999年9月28日，房屋署去信申請人，通知他下列的事項：

“本署曾於去年5月14日去信通知你，你的養豬場經評審為符合領取特惠津貼資格，應得津貼額為$194,355.12。該筆津貼額已將位於清拆範圍以外的清拆搭建物編號WR/Q/171部份豬舍（面積共115.36平方米）計算在內。但其後在清拆日期當日（即1999年6月10日），你拒絕拆卸並決定保留該部份豬舍。因此，本署在去年7月15日再另函通知你，你的應得津貼額已調整為$116,397.11。詳細計算方法，請參閱本署於本年9月1日答覆你的信件。但你至今仍拒絕領取該筆津貼額的支票。

由於你在清拆日期當日決定保留上述部份豬舍，而該豬舍現今並未受任何清拆計劃影響，所以本署不會再考慮將該部份豬舍納入計算特惠津貼之內。你應得的津貼額仍維持不變，即$116,397.11。”

3. 申請人呈遞他所聘請測量師所作的報告的一部份，以支持他申請的“特惠津貼”的款額。該部份有以下的內容：

"Under the existing policy, Mr. Chan Kam Chuen is entitled to ex-gratia payment from Housing Department for the cease of operation of his pig farm and the calculation of the ex-gratia payment is based on the area of the pig farm. We consider that it is more reasonable to calculate the ex-gratia payment with reference to the total area of the existing structure which is 764.3 square metres instead of the area of 238.575 square metres which was originally used by the Housing Department.

Amount of ex-gratia payment = 764.3 square metres x $814.65 psm = $622,637"

特惠津貼補償（ex-gratia allowance）的性質

4. 答辯人的証人葉建英在他的誓章的第2段清楚說明，申請人是按房屋署的政策而獲得特惠津貼的。第2段的內容後列如下：-

"2. Mr. Chan Kam Chuen (the Claimant) was the pig-breeder of the captioned farm of which the location is shown on the plan (P.2). This farm was covered by DLO/YL's No. MT/LM 11770 issued on 18.4.1983 (P.3-5). Affected by the KCRC West Rail (Phase I) Clearance which was announced on 3.10.1997, Mr. Chan's pig farm was assessed as eligible for Ex-gratia Allowance (EGA) according to the then prevailing clearance policy of Housing Department (Chapter VI of Clearance Division Standing Orders). The amount of EGA was computed according to the rate (814.65/m²) approved under Housing Department's Operations Section General Order No. 1/98."

5. 在Chan Mok Yee and Cheng Fung Jan trading under the name of Ocean Paper Products Factory and Attorney General (High Court Action No. 6881/1980)一案，賴恩法官 (Rhind J.) 在判詞的第10頁說：

"Government policy is not justiciable. The courts take cognizance of the law, not Government policy. Government policy belongs to the realm of politics, and also, perhaps, of social and moral duties. Courts do not allow themselves to become entangled in such matters .........."

6. 在Leung Man Cheung, Leung Kam Cheung and Others and Secretary For Planning and Lands (HCAL 274, .........909-915/2000)一案，原訟法庭的張法官在判案書的第17頁說：--

"Second, as shown in cases such as Chan Mok Yee and Cheung Fung Jan trading under the name of Ocean Paper Products Factory v. The Attorney, HCA 6881/1980, and Chan Sik Cheung v. The Director of Lands [1995] 3HKC199, an ex-gratia payment is a voluntary payment of a gratuitous nature and is not justiciable."

申請人的申請

7. 申請人用作申請的通知書是表格8A。這是申請人要求土地審裁處根據《鐵路條例》裁定補償的申請通知書，故此申請人的申請，是依據《鐵路條例》而提出的。《鐵路條例》第31條有以下的規定：

“任何人均無權對政府或任何其他人而就 -

(a) 根據本條例而獲授權作出的任何使用追討任何金錢；或

(b) 根據本條例而獲授權進行的任何工程或根據本條例而獲授權作出的任何其他事情追討任何金錢，

但在第32條所訂的獲得補償權利的範圍以內者則除外。”

8. 第32(1)規定，上述第31條所提述的獲得補償的權利，是為附表第II部第1欄列明的事項向政府追討一筆款項的權利，而該款項是按第2欄所指明的基準並顧及附表第1部而評定的。附表第II部第1欄及第2欄的細節詳列如後：

9. 申請人所申請的特惠津貼補償，並未列入《鐵路條例》的附表第II部之 內；他的申請並不是《鐵路條例》所規定的法定補償，故此申請人無權根據《鐵路條例》向答辯人提出索償，而土地審裁處亦無權審理他的申請。

10. 申請人的特惠津貼的申請，並不是法定補償的申請，所以本庭對他的申請無權審理。

11. 基於上述的理由，本席將申請人的申請撤銷。

訟費

12. 本席頒下臨時的訟費命令：申請人須支付答辯人本案的訟費（包括答辯人聘用大律師的費用）。如與訟雙方未能議定訟費的款額，則該款額由法庭評定。如與訟雙方不在21天內向本庭提出申請，則此訟費的命令作實。
