Events

1.Master Jennings ordered interrogatories within 28 days on 4th May 1995.

2.Affidavit of Service on 27th June 1995.

3.Unless Order 8th September 1995.

4.Affidavit of Service 17th October 1995.

5.Order to dismiss action 27th October 1995.

There is nothing wrong with these orders made by Master O'Donnell on 8th September 1995 and 27th October 1995 and the appeal not only hopelessly out of time also there is nothing wrong with the order.

If Plaintiff said he did not receive the summons nor the orders the proper procedure is to apply to set aside the order on the ground that he had not received the summons nor orders.
