1. At the conclusion of the hearing, we dismissed this appeal, saying that we would hand down our reasons later. When asked if he could resist costs, counsel for the appellants sensibly accepted that he could not. So the appeal was dismissed with costs. Our reasons, which we now hand down, are those given by Mr Justice Litton NPJ.
